Subscription Plan Terms and Conditions

GENTARI GO SUBSCRIPTION PLAN - TERM AND CONDITIONS (“Terms”)

BY GENTARI GREEN MOBILITY SDN BHD (“Gentari”)

  1. This Gentari subscription plan is a subscription model for Users (as defined below) to participate in, purchase or otherwise access benefits provided by Gentari (“Subscription Plan”) and is currently open to all individuals aged 18 and above who are currently residing in Malaysia (“Users”). By purchasing the Subscription Plan, Users agree to be bound by these Terms, as well as Gentari’s privacy policy which can be found on Gentari Go (as defined below).
  2. Via the Subscription Plan, Users shall be entitled to a specified discount rate at all Gentari electric vehicle charging stations within Malaysia (“Discounted Charging Rates”).
  3. Users are required to pay a one-time subscription fee during registration via Gentari Go (“Subscription Fee”). The Subscription Fee shall be displayed within Gentari Go for the reference of Users. The Subscription Plan shall be valid for a period as described within Gentari Go (“Duration of the Subscription Plan”). Once the Duration of the Subscription Plan has duly lapsed, the Subscription Plan shall automatically expire thereafter. Users are required to download and register via the Gentari Go mobile application (“Gentari Go”) first before their Subscription Plan can be activated, this process may take up to five (5) working days.
  4. The Subscription Plan is subject to a utilisation cap policy (“UCP”). The Subscription Plan can only be utilised up to a total cumulative value of RM2400.00 (“UCP Limit”). Once the UCP Limit is reached, the Subscription Plan will no longer be valid for further usage.
  5. The Subscription Plan is non-transferable, non-exchangeable, non-refundable and cannot be redeemed for cash unless otherwise stated.
  6. This Subscription Plan will automatically renew on a yearly basis (“Auto-Renewal”) and upon Auto-Renewal, Users’ account will be charged the relevant Subscription Fee for the Subscription Plan at the time of renewal.
  7. Upon expiry of the Subscription Plan or upon reaching the FUP Limit (whichever is earlier), Users shall no longer be entitled to the above Discounted Charging Rates and shall be subjected to regular charging rates as determined by Gentari.
  8. Users who wish to exit the Subscription Plan may do so by accessing Gentari Go and selecting the “Unsubscribe” option within their account settings (“Unsubscribing”). Upon Unsubscribing, the Subscription Plan benefits will cease, and any recurring charges will be discontinued.
  9. Gentari reserves the right to terminate the Subscription Plan immediately if it determines, in its sole discretion, that the Users have engaged in fraudulent activities related to the use of the Subscription Plan (“Fraudulent Activities”). Such Fraudulent Activities may include, but are not limited to:
    • Unauthorized Access: Any attempt to gain unauthorized access to the Subscription Plan or manipulate the system for personal gain.
    • False Claims: Providing false information or misrepresenting facts to obtain benefits or advantages under the Subscription Plan.
    • Abuse of Services: Intentionally utilizing the Subscription Plan in a manner inconsistent with their intended purpose or violating any Terms.
    • Unauthorized Sharing: Sharing account credentials or allowing unauthorized third parties to access the Subscription Plan.
  10. Gentari reserve the absolute right to amend, modify, vary, delete or add to any of these Terms, including the price and Discounted Charging Rates, (wholly or in part) from time to time without prior notice to the Users (“Amendments to the Terms”). It is the responsibility of Users to regularly review the Terms (via Gentari Go, Gentari’s website or any other applicable platform as the case may be). Continued participation in the Subscription Plan after any modifications constitutes acceptance of the updated Terms. For the avoidance of doubt, Amendments to the Terms by Gentari shall not entitle the Users to any claim or compensation against the Gentari for any and/or all losses or damages suffered or incurred as a direct or indirect result of the Amendments to the Terms.
  11. Gentari along with its subsidiaries, affiliates, and associated companies will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense, damage, personal injury or death which is suffered or sustained (whether or not arising from any person’s negligence) by the Users in connection with this Subscription Plan.
  12. The Terms contained herein shall prevail over any inconsistent terms, conditions, provisions or representation contained in any other promotional or advertising materials for the Subscription Plan.
  13. The Terms contained herein shall be governed and construed in accordance with the laws of Malaysia.
